These Terms and Conditions ("Terms") govern your use of our website, automateflowconsult.com, and the professional automation consulting services provided by AutomateFlow Consulting ("the Company," "we," "us," or "our").

By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

1. Scope of Services

AutomateFlow Consulting provides professional manual configuration of business workflows. Our services include, but are not limited to:

  • Configuration of GoHighLevel (GHL) subaccounts, funnels, and websites.

  • Integration of third-party tools (Zapier, Make, OpenAI, etc.).

  • Setup and optimization of SMS and Email marketing campaigns.

  • Custom workflow logic and automation engineering.

Note: We are a consulting firm. We do not own or control the third-party platforms used in your workflows. Your use of those platforms is subject to their respective terms of service.

2. SMS & A2P 10DLC Compliance

Our SMS program sends automated appointment reminders, service updates, and marketing communications to clients who have explicitly opted in.

  • Opt-In: Consent is collected via web forms with a dedicated, un-pre-checked checkbox for SMS consent.

  • Opt-Out: You can cancel the SMS service at any time. Simply text "STOP" to the number sending you messages. We will send a final confirmation of your unsubscribe status.

  • Support: For issues or questions, text "HELP" or email admin@automateflowconsulting.com.

  • Message & Data Rates: Standard message and data rates may apply. Message frequency varies based on your interaction with our services.

Client Responsibility: When we configure SMS systems for you, you (the Client) are the "Sender of Record." You are responsible for ensuring your contact lists are TCPA compliant and that you have obtained proper legal consent from your recipients.

3. Intellectual Property

  • Our Property: We retain all rights, titles, and interests in any proprietary templates, "snapshots," custom scripts, or unique workflow logic developed by us prior to or during the engagement.

  • Client Property: The Client retains ownership of all data, branding, and content provided to us. Upon full payment, the Client is granted a non-exclusive license to use the specific workflow configuration built for them.

4. Third-Party Tools and API Liability

Our services rely on third-party software (e.g., Twilio, Mailgun, GoHighLevel). AutomateFlow Consulting is not responsible for:

  • Service outages or downtime of third-party platforms.

  • Changes in third-party pricing, API structures, or 10DLC regulations.

  • Account suspensions resulting from the Client’s violation of third-party Acceptable Use Policies.

5. Professional Fees and Payment

Services are billed as outlined in your specific Statement of Work (SOW). All manual configurations require a non-refundable deposit before work begins. We reserve the right to suspend workflow access or halt configuration if payments are overdue by more than seven (7) days.

6. Limitation of Liability

To the maximum extent permitted by law, AutomateFlow Consulting shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, arising from the use or inability to use the automated systems we configure. Our total liability is limited to the amount paid by the Client for the specific service in question.

7. Data Privacy and Security

We implement industry-standard security measures. However, as an automation consultant, we require administrative access to your accounts. We recommend that Clients change all passwords and revoke our access once a project is formally handed over. We are not liable for security breaches occurring after the handover date.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which AutomateFlow Consulting operates, without regard to conflict of law principles.
